Upskirt or no?

Here in the UK, a bill was recently put forward that would make upskirting illegal. Bafflingly, one old fart of an MP chose to object to it and it was blocked. (I would love to hear him try to justify why)

Aside out of the way, when I was in Sin the other night waiting for someone who never showed, I saw this person and it made me wonder, would seeing up her skirt be considered upskirting? I mean its pretty hard not to considering her skirt is little more than a belt. Since she’s basically got her vag out for all to see (not to mention that she also has her tits hanging out), it seems more like exhibitionism on her part to me. So my vote goes to no in this case.
